Federal Indictment Charges Two Oakland Police Pilots and FAA Inspector in Helicopter Certification Scheme

Two police officers with the Oakland Police Department and an inspector from the Federal Aviation Administration are facing serious federal criminal charges after prosecutors uncovered an alleged conspiracy to falsify official helicopter pilot certifications. The case highlights significant concerns regarding the integrity of mandatory aviation testing and oversight within law enforcement flight operations.

The defendants named in the federal indictment are Oakland police officers Brandon Mart and David Mac, alongside William Miller, who serves as an aviation safety inspector for the FAA. Federal prosecutors contend that the trio engaged in a deliberate effort to bypass regulatory standards, allowing the officers to obtain official pilot credentials under false pretenses without demonstrating the required flight competencies.

According to charging documents filed on August 27, the illicit arrangement operated across an eight-month span from July 2023 to March 2024. During this timeframe, the officers and the inspector allegedly coordinated to submit fraudulent records directly to federal regulators, asserting that mandatory testing benchmarks had been successfully met when they had not.

Central to the federal allegations is the circumvention of official "checkrides," which are compulsory, rigorous examinations required by the FAA before an individual can secure a pilot certification. Under federal standards, a valid checkride comprises both an intensive oral evaluation covering aviation regulations and aircraft mechanics, as well as a comprehensive practical flight test requiring the candidate to execute specific airborne maneuvers under an examiner's scrutiny.

The indictment outlines how the standard evaluation process was repeatedly compromised, stating that Mart fraudulently obtained three checkride certifications while Mac secured one. Federal authorities allege that in some instances the officers failed to perform the mandatory flight requirements, while in other situations the documented testing flights never took place at all.

One prominent example cited by prosecutors occurred on July 20, 2023, when Miller formally endorsed paperwork asserting he had conducted a comprehensive checkride for Mart. The official records stated that the flight occurred out of Oakland International Airport between 7:13 a.m. and 12:32 p.m. However, investigators discovered that the flight never occurred and that Miller was physically located across the country in Lakeland, Florida, at the time he claimed to be assessing Mart in California.

The fraudulent activity allegedly continued into early 2024 with additional fabricated evaluations. On February 27, 2024, Mart reportedly operated an aircraft for an evaluation, but prosecutors say he failed to carry out the specific maneuvers mandated for official certification. Despite the incomplete performance, Miller allegedly signed off on the paperwork, certifying that the officer had satisfied all necessary requirements.

The very next day, on February 28, 2024, Mac and Miller signed off on another purported checkride documented at Oakland International Airport. Subsequent reviews of flight tracking data and airport records revealed that the specific helicopter listed in the submitted documentation was never in the air during the designated timeframe, indicating that the test was entirely fabricated on paper.

During a recent appearance in federal court, Mart, Mac, and Miller all entered pleas of not guilty to the multiple charges brought against them. The charges detailed in the indictment include conspiracy, defrauding the FAA, and the falsification of records. Following the preliminary hearing, the court scheduled the trio to return for their next legal appearance on November 30.

The Oakland Police Department took swift internal action following the formal unveiling of the charges. The department confirmed that both Mart and Mac have been removed from active duty and placed on paid administrative leave while the federal judicial process and internal reviews run their course.

Oakland Police Chief James Beere addressed the situation publicly in a video statement released on Instagram, noting that department leadership first learned of the federal allegations on the same day the defendants appeared in court. Although Chief Beere did not explicitly mention Mart or Mac by name in the address, he underscored the gravity of maintaining public trust within the ranks.

Chief Beere emphasized his commitment to integrity within the police force, stating that when he assumed leadership, he established that any individual who violates the law within the city must be held accountable. He added that this principle applies directly to members of the police force, who hold an exceptional level of community authority and public responsibility.

In response to the allegations, the Oakland Police Department has initiated a comprehensive internal audit examining the flight credentials and records of all other pilots operating within its helicopter division. The review aims to ensure that all airborne personnel possess authentic, properly obtained qualifications to conduct specialized police operations.

Significant operational questions remain unanswered regarding the extent of the officers' airborne duties. The department declined to clarify whether Mart or Mac had utilized the disputed certifications to operate active law enforcement flights over the community, citing the ongoing nature of the personnel matter and the active criminal investigation.

When approached for comment regarding the indictment and the alleged actions of its inspector, the Federal Aviation Administration declined to provide statements regarding the active investigation. The case continues to develop as federal prosecutors prepare for the upcoming November court proceedings.
